| Abstraksi | : | In the Dutch colonism era, the valid law of criminal procedure in Indonesia was of various kinds and there was a difference in law treatment for the Indonesian who has broken the laws. The time span of valid law of criminal procedure was I.R (het Inlandsch Reglement) since 1846 and then renewed with S. 1926-559, and continuously changed into the Herziene Indonesisch Reglernent or abbreviated as HIR (Staatsblad of 1941 No. 44). In 31 of December 1981, the Ordinance of Republic Indonesia No. 8. 1981 about law of criminal procedure was generated and was abbreviated as KUHAP. Then the Herziene Indonesisch Reglement (MR) stated as invalid for it .vas not match any more with the aspiration of National laws. Based on the conception, thought and aspiration, the contains of Regulation No. 8, 1981 has fulfilled the expectation and requirement as a simple, fast, honest, fair and humanly trial, as has been instructed by the basic Ordinance of Judicial Affairs Authority. One of the bases of KUHAP is a square deal (to all people) in front of law without any difference indicating that KUHAP has held in esteem the human right. The system of criminal justice arranged through the KUHAP should pay attention on to the basis it's contained, the implementation should be in accordance with expectation. Agree with the paragraph 4 article 2 Ordinance of Republic Indonesia No. 14, 1970, since interconnected with criminal justice system so each institution as an investigating office r (Police), General Prosecutor (Judiciary) and the Court should execute the bases above accordingly |
